Minor Works

Development consent is not always needed for minor works to a heritage item or a property in a heritage conservation area.

Hunters Hill Local Environmental Plan 2012 provides for minor works to heritage items and to buildings within heritage conservation areas to be excluded from the need to obtain development consent, if a heritage exemption letter has been issued by Council in accordance with Clause 5.10(3) of Hunters Hill Local Environmental Plan 2012.

Requirements:

  • The work is minor (or is for maintenance). Minor works may include:
    • aerials, antennae and communication dishes located on rear roofs of houses
    • air conditioning units with condensers located away from front elevations
    • BBQ areas and other outdoor cooking structures located in rear gardens
    • clothes hoists and clothes lines located behind the front building line
    • fence repairs or replacement – like for like
    • weatheboard repairs or replacement – like for like
    • roof replacement like for like (for example slate roof replaced with a new slate roof with same styles of flashing and ridge cappings)
    • timber window repairs or replacement like for like (with no change in the size of the window opening and no change in window design or appearance)
    • repainting exteriors like for like or in a heritage colour scheme (does not include painting of existing unpainted surfaces such as sandstone or face brickwork, does not include cement rendering or painting with cement based paint to unpainted surfaces such as brickwork or sandstone)
    • small garden structures such as garden sheds, cabanas, cubby houses, greenhouses, located in rear gardens, at least 900mm from property boundaries, not larger than 10 square metres in area and with a maximum height of 3m above existing ground level. The materials used for the shed or garden structure should blend with the surrounding environment, have a low impact on surrounding properties, and stormwater should be dealt with so as not to cause a nuisance or impact on neighbouring properties 

There is no fee for this application.

Your application must include:

  • a drawing showing the exact location of the proposed work in relation the building/place
  • a detailed description of the proposed works
  • photographs of the building/place as a whole
  • photographs of the area of the proposed work
  • product samples/brochure (if the application is for repainting, a colour sample must be provided).
  • any quotes for the proposed work which include details of the work
